Orders

Any order submitted by you is your offer to enter into a contract with us. Shortly after receipt of your order, we will send you an e-mail confirming the products you have ordered and that we have accepted your order subject to these terms & conditions, payment, and availability of the items ordered. We must receive payment for the whole price for the goods that you order before your order can be accepted. If your payment details cannot be authorised for any reason, we will tell you. A legally binding contract between us will only come into effect when our acceptance is dispatched. The details (price etc) mentioned in the acceptance prevail over the details mentioned in any publicity.

Canceling orders

You may not cancel orders without written authorisation from us. This authorisation shall be subject to compensation for all damages caused by such cancellation. Without prejudice to our right to claim performance or compensation for any damages incurred in excess, you agree that these damages shall be valued at a minimum of 30% of the amount invoiced by us.

Availability

Prices, offers and products are subject to availability and may change before (but not after) we accept your order.

Prices

All prices and charges on this website are quoted in RUSSIAN RUBLES, including VAT but excluding delivery charges. The total cost of your order will be the cost of the items you order, the cost of any extras you choose, plus the applicable delivery charge. All these details will be clearly stated in your shopping basket before you dispatch your order.
IMPORTANT: import duties levied by local authorities are never included in the delivery charges quoted at checkout. If you purchase outside the Russian Federation, the local government may (this depends on each country's laws and regulations) contact you to cover import duties and/or other taxes.
If a product or service is listed at an incorrect price due to a typographical error or mistake in the pricing information we receive from our suppliers, we reserve the right to cancel the contract. If you decide to cancel your order after we have informed you of the pricing error and you have already paid for the goods, we will provide you with a full refund as soon as reasonably practicable (and in any event within thirty to thirty days of cancellation). In these circumstances, you will not be entitled to claim compensation for disappointment suffered or for any loss you might otherwise have suffered.
All goods shall remain our property until we have received full payment of all invoiced amounts, including costs, interest, compensation claims and taxes, if any.

Delivery

DEVILISH will make every effort to transfer all orders to the transport company within three working days of order acceptance. DEVILISH is not responsible if delivery is made at a later date. Delivery times stated in our faq or elsewhere are indicative and do not form part of the contract between DEVILISH and the customer.
As we entrust the delivery of parcels to third parties, we cannot influence the delivery times. Due to unforeseen circumstances (customs delays) parcels may be delayed. DEVILISH has the right to deliver parcels within ninety days of order acceptance without any consequences.
In the event that parcels cannot be delivered within the deadline, the customer will be notified. The customer can either cancel their order at that point or come to another agreement with DEVILISH. In case of cancellation, the customer will receive a refund as soon as possible, but no later than thirty days after the cancellation of the agreement.
As mentioned above, third parties are in charge of delivering your parcel. If they are unable to deliver your parcel at the first attempt, they will leave a message or try to contact you (by email or phone) to let you know when you can expect a second delivery attempt or where you can collect your parcel. Remember that your parcel must be received within 14 days. If the courier service is unable to deliver the parcel due to an incomplete/incorrect address, or if the parcel is not received at the pick-up point within 14 days of notification, the parcel will be sent back to mxdvs. Such returns are not prioritised by the shipping companies. Re-dispatch can only be made once we have received the original parcel in our warehouse. The customer is responsible for any additional charges that may be applicable. If the customer requests a refund after the parcel has been returned due to an incorrect address or because they did not collect the parcel at the pick-up point, a processing fee of €5 will be deducted from the refund amount.
Any complaints about the condition of the goods on delivery (including missing parts) should be sent to devilish ( dxvxlxsh@gmail.com ) no later than two working days after receipt of the goods.

Payment methods

By using a specific credit card, you confirm that the credit card used is yours. The amount due will be reserved in your account at the time of order confirmation, but will only be debited from your account once DEVILISH has accepted your order. In the rare case that your credit card cannot be confirmed, we will postpone delivery and contact you. In this case, DEVILISH is not responsible for any delay or non-delivery.

Defective goods

In the event that the goods are damaged or defective, claims relating to quality defects or non-conformities must be submitted to us under penalty of invalidity within 2 months of delivery (in the case of visible defects).
Claims must be made by email ( dxvxlxsh@gmail.com ) with all relevant data including order number and photographs, otherwise we are entitled to consider the claim inadmissible.
If the claim is justified, our liability shall be limited to the free replacement of the defective products or, as the case may be, the value of the order.
We apply the statutory minimum warranty period of two years if the goods do not correspond to the order placed. This means that in the event of a defect in the goods, a free repair or replacement is possible within two years of delivery. As far as possible and reasonable, you have the choice between repair or replacement. Only if the repair or replacement is excessive, impossible or cannot be carried out within a reasonable time, you are entitled to demand a reduction in price or cancellation of the purchase contract.

Return policy for defective goods

For "Off-the-shelf" goods and in case you are a consumer, you have, irrespective of the reason, the right to return the goods within 14 days from the day of delivery of the goods without any compensation being charged. In such a case, we will refund the sum paid, minus the costs of transportation to the card used for payment.
This non-quibble refund is subject to the return of the goods in the same condition that they were delivered. You are responsible for all costs of returning the goods. If the goods are not properly repacked and therefore cannot be resold as new, we reserve the right to apply a charge of 30% of the price you paid for the goods, which you agree we may discount from your refund for the goods or, in case of an exchange, the charge of 30% must be paid by the customer before we proceed with shipping the new package. This also counts for goods returned covered in animal hair.
If the goods are damaged whilst in your care or if you fail to return all parts of the goods, we have the right to withhold payment of all or part of the refund in respect of the goods as compensation for our loss on these goods. In the case of an exchange, the compensation must be paid by the customer before we proceed with the exchange.
Free shipping over xxx,xx₽ - items that will be returned while free shipping is optional at the check out will have to cover shipping costs of the package if it reaches below the total amount needed to have access to free shipping discount.

Invalidity

In the event that one or more of the terms and conditions set out in these terms and conditions are declared invalid by the competent authority, the remaining terms and conditions will remain in force and you will be bound by them.

Waiver

If you breach these terms and conditions and we take no action, we will still be entitled to exercise our rights and remedies in any other situation where you breach them.

Applicable right

All sales contracts between the parties and these terms and conditions shall be governed exclusively by the laws of the Russian Federation.

Competent courts

You agree to submit to the exclusive jurisdiction of the Moscow Court for all disputes relating to contracts of sale between you and us and arising in connection with these terms and conditions. If you are a consumer, you may only bring an action against us in a court in Moscow (Russian Federation)

Reproduction or use of this information for other purposes is prohibited. Reproduction or use of the distinctive marks on this website is prohibited.

General Responsibility

Our total liability to you under these terms and conditions shall not exceed the price paid for goods purchased by you through this website, provided that we have taken reasonable care in delivering the goods to you.

In any event, we shall not be liable to you for loss of revenue, profit, anticipated savings, goodwill or business opportunity, for damage to your reputation or for any loss which we both could not reasonably have foreseen at the time we accepted your order.

We shall not be liable for any delay or failure to fulfil these terms and conditions if the delay or failure is caused by any events beyond our reasonable control. Such events include, but are not limited to, strikes, lockouts, transport stoppages, fires, floods, earthquakes, storms, acts of God, war, civil commotion, acts of terrorism or malicious damage to or destruction of our premises, equipment or goods, difficulties in obtaining supplies, shortages of materials or shortages of products required for production.
